Interpretation of Policies for the Foreign Experts Program in Hainan Province

The Foreign Experts Program in Hainan Province refers to projects established in accordance with the province's construction needs, which provide support for foreign experts to carry out activities such as scientific research, technical consulting, product development, academic exchange, achievement transformation (commercialisation), and management services in Hainan. Foreign experts can carry out project research with the support of the project group.

Project duration is divided into one or two years. To ensure the effectiveness of project execution, experts are encouraged to come to Hainan for offline communication and cooperation. Hainan supports various methods of work such as remote video and online office to complete various tasks.

Foreign experts who participate in Hainan Province's foreign experts’ program can receive funding support for expenses such as transportation, salary, consulting fees (lecture fees), subsidies, living expenses, and other expenses.

(1) Transportation expenses for experts: Foreign experts are reimbursed for their round-trip transportation expenses incurred while working in Hainan, as well as expenses incurred while traveling in China for work purposes. Reimbursements are based on actual expenses and must be supported by compliant receipts.

(2) Expert salary: Refers to the remuneration agreed upon by the project group and the foreign expert through the signing of a labour contract or work agreement. If the expert is working in China for more than 90 days at a time, they must sign a labour contract or work agreement.

(3) Expert consulting fees (lecture fees): For foreign experts who have not established a labour relationship with the project group, subsidies are provided for their services such as consultation, lectures, teaching, and technical services, based on a standard of no more than 3,000 yuan per session.

(4) Expert subsidies: Foreign experts who work for short-term periods (within 90 consecutive days in Hainan) at the project group without signing a labour contract or work agreement are provided with living subsidies during their stay in Hainan. Expert subsidies are granted based on the number of days the foreign expert works on the project in Hainan Province, with a standard of no more than 1,000 yuan per day.

(5) Expert living expenses: The rental (accommodation) expenses incurred by foreign experts during their work in Hainan are reimbursed based on actual expenses and must be supported by compliant receipts.

(6) Other expenses: Refers to technical material expenses, outstanding contribution award fees, and other expenses incurred by experts during their work in Hainan. The project unit will apply for the funds and the expenses will be disbursed within the approved limit.

Foreign experts can only choose one type of funding support from expert salary, consulting fee (lecture fee), and expert allowance, and the disbursement should comply with relevant national tax regulations. If the expert salary already includes expert transportation expenses, expert living expenses, or other related expenses, they cannot be duplicated. During their work in Hainan, foreign experts must strictly abide by Chinese laws and regulations and implement relevant regulations on work style, academic integrity, and scientific research ethics.

《海南省外國專家項目》政策解讀

海南省外國專家項目是指根據我省建設需要設立的，資助外國專家來瓊開展科研、技術咨詢、產品研發、學科建設、學術交流、成果轉化、管理服務等活動的項目。外國專家依托項目單位開展項目研究。

項目期限分為1年期或2年期，為確保項目執行效果，鼓勵專家來海南開展線下交流合作，支持采用遠程視頻、網絡辦公等多種方式開展相關工作，完成各項任務。

參與我省外國專家項目，對外國專家給予薪酬、補貼等方面的經費支持，具體包括交通費、工薪、咨詢費（講課費）、補貼、生活費及其他費用。

（一）專家交通費：對外國專家本人因來瓊工作產生的往返交通費用，以及在中國境內因工作需要乘坐交通工具所發生的費用，憑合規票據按照實際支出核銷。 ??????

（二）專家工薪：指項目單位與外國專家通過簽訂勞動合同或者工作協議等方式約定的工作報酬；單次來華工作90天以上，必須簽訂勞動合同或工作協議。

（三）專家咨詢費（講課費）：對未與項目單位建立勞動關系的外國專家，因從事咨詢、講座、授課、技術服務等勞務，按照每次不超過3000元的標準進行資助。

（四）專家補貼：對在項目單位從事短期（連續在瓊工作90天以內）工作，未簽訂勞動合同或工作協議的外國專家在瓊期間給予生活補貼資助。專家補貼按外國專家在我省執行項目天數發放；標準為每天不超過1000元。

（五）專家生活費：對外國專家在瓊工作期間實際發生的租房（住宿）費用，憑合規票據按照實際支出核銷。

（六）其他費用：指專家在瓊工作期間發生的技術資料費、突出貢獻獎勵費等，此項費用由項目單位提出經費申請，在批復額度內支出。

專家工薪、專家咨詢費（講課費）、專家補貼只能選擇其中一種方式給予資助，發放應符合國家有關稅法規定。專家工薪如已包括專家交通費、專家生活費或其他相關費用，則不能重復支出。

外國專家在海南工作期間，要嚴格遵守我國法律法規，落實作風學風和科研誠信相關規定。
